By advertising on the KAYAK Network, the individual or organization (the “Advertiser”) or any individual or organization authorized to act on behalf of the Advertiser is bound by these Advertising Policies and Guidelines. Ads consisting of advertising materials and/or creatives (“Advertising Content”) must perform acceptably on the KAYAK Network and adhere to these Policies and Guidelines. KAYAK Network includes all properties that are branded KAYAK, OpenTable, momondo, swoodoo, checkfelix, Cheapflights, HotelsCombined, Mundi, Travelsearch, and/or Roomsearch.
All Ads placed with the KAYAK Network are governed by the IAB Standard Terms and Conditions found here, except as modified by an Insertion Order Addendum and Additional Terms.
Advertising Policies
All Advertising Content must be clearly identifiable as an advertisement (“Ad”). The Advertiser is solely responsible for all Advertising Content, targeting, URLs, and bids, whether generated by or for the Advertiser. The Advertiser will honor and fulfill all Advertising Content including any offer, including without limitation discounts, savings claims, price offers, product offers, offer periods, contests and sweepstakes and all related prizing, availability, blackout dates, and/or travel dates. The Advertiser will substantiate and verify all Advertising Content including any price offer or savings claim and shall comply with the applicable advertising laws, rules, regulations, and requirements of the specific region or locale where the Ad(s) will be displayed. The Advertiser will clearly and conspicuously display a disclosure on all Advertising Content that includes a specific price offer or savings claim where terms and conditions apply (i.e., *Ts&Cs apply”) with corresponding markings, such as asterisks. The Advertiser will not, and will not authorize any other party to, advertise anything illegal or engage in any illegal, fraudulent, unfair, or deceptive business practice. Ads or Advertising Content will not mislead KAYAK Network visitors or users. Ads or Advertising Content will not imitate, depict, or resemble operating system dialog boxes (or similar functionalities) or error messages. Ads or Advertising Content featuring interactivity will be functional in all aspects. Ads or Advertising Content will not imitate current events or news headlines in any aspect. Native advertisements will be first party served. The Advertiser will clearly, conspicuously, and proximately label or identify native advertising as sponsored material and include all necessary disclosures (e.g., “Ad”, “Paid Advertising”, “Sponsored”, etc.). Ads or Advertising Content associated with politics are not permitted. KAYAK, in its sole discretion and without liability, reserves the right to deny, reject, suspend, or remove any Ad or Advertising Content at any time and for any reason. All Ads or Advertising Content must be approved by KAYAK, in its sole discretion and without liability, prior to posting on the KAYAK Network. KAYAK’s acceptance of an Ad or Advertising Content will in no way be deemed to constitute in any manner whatsoever an endorsement by KAYAK thereof, and Advertiser remains solely liable therefor. In addition, exercise of the KAYAK Network’s approval rights or the KAYAK Network’s review and comment on any Ads or Advertising Content will not under any circumstances void, nullify, or constitute a waiver of the Advertiser’s indemnification obligations or of any of the KAYAK Network’s rights. Once an Ad or Advertising Content has been posted on the KAYAK Network, KAYAK has the right to remove previously approved Advertising Content if KAYAK determines at any time, in its sole discretion and without liability, that Advertiser Content does not meet KAYAK’s standards.
Prohibited Ads or Advertising Content:
Ads or Advertising Content will not include anything inappropriate, offensive, illegal, deceptive, infringing, or fraudulent, including, but not limited to, the following:
Any illegal activityHate speech, hate-mongering, or racism (e.g., racist slurs and imagery)ProfanityPortraying a culture as a parody or mockery or in an insensitive lightPolitical or controversial landmarksAlcohol (see exception below), Tobacco, Drugs & WeaponsAny illegal substance, drugs of any kind, and/or any related drug paraphernaliaWeapons of any kind, including the facilitation or promotion of the sale or use of any weaponTobacco advertisements (cigarettes, cigars, pipes, chewing tobacco, vapes, etc.)Adware, malware, phishing offers, or virusesProvision of false information of any kind to visitors or usersGambling (excluding accommodations where a casino is a feature of the property)Unreasonable or highly unlikely product or service claimsAnimal abuse, captivity, cruelty, exploitation, harm, and/or humiliationPornographic, obscene, defamatory, libelous, or deceptive content (includes any material that defames the KAYAK Network or any of the KAYAK Network’s parent, affiliates, or products and services)Any content that infringes, misappropriates or violates any intellectual property right or any other right of any third party (including, without limitation, copyright, trademark, patent, moral rights, rights of publicity and privacy, false light, etc.) or would give rise to a claim of deceptive or false advertising
Permissible Ads or Advertising Content with Restrictions:
Subject to our Policies, all Ads or Advertising Content that promote the purchase or use of beer, wine, or hard liquor is permissible as long as the Ad or Advertising Content, particularly the imagery and messaging, ties to responsible alcohol use and travel, vacationing, or dining in the case of OpenTable Ads. Alcohol bottle(s) cannot be the primary image within the Ad or Advertising Content. Promotion or depiction, whether expressed or implicit, of any of the below behaviors is strictly prohibited:
Drinking and drivingIrresponsible drinkingDrunken behaviorOverconsumptionUnderage drinkingAll Ads or Advertising Content involving or related to alcohol will require the appropriate disclosures and appropriate age restrictions in place on Advertiser’s landing page(s).
Data Use:
Ads or Advertising Content will not solicit or collect in any manner whatsoever any personally identifiable information from KAYAK or KAYAK Network visitors or users without their knowledge and the written consent of KAYAK. Without KAYAK’s prior written consent, Advertisers are prohibited from storing, collecting or using KAYAK or KAYAK Networks visitors’ or users’ behavior or search data collected directly or indirectly from Ads or Advertising Content. Without KAYAK’s prior written consent, Advertisers are prohibited from retargeting KAYAK or KAYAK Network visitors or users via conversion tags, creative tags, data tracking tags, or 1×1 tags.
Specifications:
All Advertising Content shall adhere to the specifications for each specific advertising product as set forth on the KAYAK Network ad specs page. All Advertising Content that is co-branded with a KAYAK Network property shall adhere to the applicable property’s brand guidelines. Ads or Advertising Content shall be contextually appropriate, as determined by KAYAK in its sole discretion and without liability, in order to be published on the KAYAK Network. Each Advertiser will clearly post its privacy policy on its website.
